Welcome to AMCO Pharma

These Terms of Service ("Terms") constitute a legally binding agreement under the Contract Act 1872 and Sale of Goods Act 1930 of Pakistan. They govern your purchase and use of certified poultry medicines from AMCO Pharma. Our operations comply with Drug Regulatory Authority of Pakistan (DRAP) regulations, Drug Act 1976, provincial livestock laws, and Pakistan Veterinary Medical Council guidelines. By accessing our website or purchasing from us, you accept these Terms and agree to comply with all applicable Pakistani laws. Please review carefully before ordering.

Acceptance of Terms

Agreement to Terms

By accessing or purchasing from AMCO Pharma, you agree to be bound by these Terms of Service and comply with all applicable laws of Pakistan including the Contract Act 1872, Sale of Goods Act 1930, Drug Regulatory Authority of Pakistan (DRAP) regulations, and provincial livestock laws. If you do not agree with these terms, please do not use our services.

Legal Capacity

You must be at least 18 years old and legally capable of entering into binding contracts under Pakistani law. For commercial poultry operations, you must have appropriate business registration (NTN) and comply with provincial livestock department requirements.

Modifications

We reserve the right to modify these Terms in compliance with Pakistan Contract Act 1872. Material changes will be notified via email or WhatsApp 30 days in advance. Continued use of our services after changes constitutes acceptance of the new Terms.

Poultry Medicine Supply Terms

Product Authenticity and Licensing

All poultry medicines supplied are genuine, DRAP-registered products with valid import/manufacturing licenses. We maintain proper pharmaceutical distribution licenses as required by Drug Act 1976 and operate in compliance with provincial livestock and poultry regulations in Punjab and across Pakistan.

Veterinary Prescription Requirements

Certain Schedule H medicines require valid veterinary prescriptions from Pakistan Veterinary Medical Council (PVMC) registered practitioners. We reserve the right to verify prescriptions and refuse sales of controlled medications without proper documentation as mandated by DRAP.

Proper Use and Administration

You agree to use poultry medicines strictly according to product labels, adhere to recommended dosages, observe withdrawal periods before slaughter/egg collection, follow veterinary guidance, and comply with Pakistan's food safety standards. Misuse may result in account suspension and reporting to relevant authorities.

Account Responsibilities

You are responsible for providing accurate farm/business information, maintaining confidentiality of your account credentials, ensuring authorized personnel make purchases, and notifying us immediately of any unauthorized access or security breaches.

Pricing, Payment and Delivery

Pricing in Pakistani Rupees

All prices are quoted in Pakistani Rupees (PKR) and are subject to change based on import costs, exchange rate fluctuations, and regulatory fees. GST/Sales Tax as per Federal Board of Revenue (FBR) regulations will be applied. Confirmed orders will be honored at the agreed price regardless of subsequent changes.

Payment Methods

We accept bank transfers to Pakistani bank accounts, JazzCash, EasyPaisa, credit/debit cards via secure payment gateways, and cash on delivery (COD) for orders within specified limits. Business customers may qualify for credit terms (30-60 days) subject to credit approval and documentation.

Delivery Across Pakistan

We deliver certified poultry medicines across Pakistan via licensed courier services. Delivery times vary by location (2-7 business days). Temperature-sensitive products (vaccines, biologicals) are shipped with cold chain management. Risk of loss transfers upon delivery or after failed delivery attempts due to incorrect address.

Returns and Refunds Policy

Unopened medicines in original packaging with intact seals can be returned within 7 days of delivery with valid reason. Vaccines, biologicals, opened products, and temperature-sensitive items are non-returnable per pharmaceutical safety standards. Defective or damaged products will be replaced free of charge. Refunds processed within 14 business days to original payment method.

Product Quality and Pharmaceuticals Regulations

DRAP Compliance

All products meet Drug Regulatory Authority of Pakistan (DRAP) quality standards, carry proper registration numbers, are sourced from licensed manufacturers, and comply with Drug Act 1976 and Drug Sales and Distribution Rules. We maintain complete chain of custody documentation.

Storage and Handling Instructions

Poultry medicines must be stored according to label instructions (temperature, humidity, light protection). We ensure proper storage during warehousing and shipment. After delivery, you are responsible for appropriate storage conditions. Improper storage voids any quality guarantees.

Adverse Event Reporting

You must report any adverse reactions, unexpected side effects, or product quality concerns to us immediately. We will investigate and report to DRAP as required by pharmacovigilance regulations. Your cooperation in safety monitoring is mandatory and helps protect Pakistan's poultry industry.

Resale Restrictions

Medicines purchased are for your own poultry farm use only. Unauthorized resale, repackaging, relabeling, or distribution without proper pharmaceutical licenses is illegal under Drug Act 1976 and Pakistan Penal Code and will result in legal action and account termination.

Liability Limitations and Warranties

Product Warranties

We guarantee that all medicines are genuine DRAP-registered products with valid expiry dates (minimum 6 months at delivery for most products). Vaccines have minimum 3 months validity. We warrant products are stored and transported per manufacturer specifications until delivery.

Limitation of Liability

Under Pakistani law and Sale of Goods Act 1930, our liability is limited to product replacement or refund of purchase price. We are not liable for: (1) losses due to improper administration or storage by customer, (2) indirect losses including poultry mortality beyond direct product defect, (3) failure to follow withdrawal periods, or (4) force majeure events including import restrictions or natural disasters.

Customer Indemnification

You agree to indemnify AMCO Pharma against claims arising from: (1) misuse of medicines, (2) violation of DRAP regulations, (3) failure to observe withdrawal periods causing food safety violations, (4) unauthorized resale, or (5) providing false information during purchase.

Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of Islamic Republic of Pakistan including Contract Act 1872, Sale of Goods Act 1930, Drug Act 1976, Prevention of Electronic Crimes Act 2016, and all applicable DRAP regulations. The venue for legal proceedings shall be courts in Sargodha or Lahore, Punjab province.

Dispute Resolution Process

In case of disputes: (1) First contact our customer service for amicable resolution within 15 days, (2) If unresolved, proceed to mediation under Arbitration Act 1940, (3) Arbitration to be conducted in Sargodha/Lahore in Urdu or English language, (4) Arbitration decision is binding on both parties. Legal proceedings only after exhausting these remedies.

Regulatory Complaints

For product quality or safety concerns, you may also file complaints with Drug Regulatory Authority of Pakistan (DRAP), provincial livestock departments, or Pakistan Veterinary Medical Council. We cooperate fully with all regulatory investigations.

Jurisdiction and Enforcement

Pakistani courts have exclusive jurisdiction over all matters arising from these Terms. Any judgments shall be enforceable in Pakistan under Civil Procedure Code 1908. Both parties submit to the jurisdiction of Sargodha and Lahore courts, Punjab province, Pakistan.
